Terms of Service | PyDynamics

These Terms of Service ("Terms") govern your access to and use of pydynamics.co.za (the "Platform," "we," "us," or "our"), operated by Peniel Mogowane trading as PyDynamics Platform in the Republic of South Africa. These Terms cover all Platform features, including Python preparation content, lessons, quizzes, badges, mini-projects, capstone work, the in-browser code editor, the AI tutor feature, GitHub integration (Phase 2), and the community forum.

By creating an account or accessing the Platform, you agree to be bound by these Terms and our Privacy Policy.

1. Eligibility & Who Can Use PyDynamics

General Eligibility: You must be 18 years of age or older, and capable of forming a legally binding agreement under South African law, to independently register for and use the Platform.
High School Track Exception: If you are between 13 and 17 years old, you may only register and use the Platform through our High School track, strictly with the involvement and logged consent of a parent, legal guardian, or school authority. If you register or consent on behalf of a minor, you represent and warrant that you have the legal authority to grant such consent.
Age Verification: By creating an account, you represent that the Date of Birth and eligibility information provided during registration is accurate. We strictly prohibit registration by anyone under 13 years of age.

2. Your Account & Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately at info@pydynamics.co.za if you suspect unauthorized access or a security breach. We reserve the right to suspend or terminate any account that provides false registration data or violates these Terms.

3. Program Structure: Phase 1 & Phase 2

Phase 1 (Bootcamp):Phase 1 is a self-paced intensive program covering Python core concepts, executed within the Platform's in-browser environment. Quiz scores, completion progress, and badges reflect internal activity on pydynamics.co.za and do not constitute an accredited academic qualification or external certification.
Phase 2 (Career Track): Phase 2 is currently coming soon and is not open for self-enrollment. Access requirements (which may include GitHub workflows, project deployments, and technical evaluations) will be announced when the track opens. Completion of Phase 1 does not guarantee entry into Phase 2.
No Guaranteed Outcomes: Phase 1 is currently offered at no cost. We do not guarantee employment, learnership placements, or specific career outcomes as a result of using the Platform.

4. Code & Project Submissions

Ownership: You retain the rights you hold in original source code you write and submit for exercises, mini-projects, and capstones on the Platform.
Limited permission: You grant only the service permissions described in the software and learning content terms. They cover storage, execution, assessment and authorised review, including necessary providers. Submission does not transfer ownership or authorise promotional reuse of identifiable work.
Originality: You represent that submitted code does not infringe upon the intellectual property rights or trade secrets of any third party.

5. Community Forum Rules

Our community forum is designed for collaborative learning. When posting content or interacting with other users, you agree not to post material that is:

Unlawful, defamatory, harassing, abusive, hateful, or sexually explicit;
Infringing on third-party intellectual property or privacy rights (including posting personal identity numbers, financial details, or private contact information without consent);
Intended to distribute spam, unauthorized promotional links, or malicious scripts.

We reserve the right to moderate, edit, or remove any forum thread or reply and suspend offending accounts without prior notice.

6. AI Tutor Feature

The Platform integrates an AI-assisted tutor to provide educational guidance and code explanations.

AI-generated responses are automated and provided for learning assistance; they may occasionally contain errors or inaccuracies. You are expected to independently verify solutions.
You agree not to input sensitive personal information (such as South African ID numbers, passwords, or personal financial details) into the AI tutor prompts.

7. Third-Party Infrastructure & Services

The Platform relies on third-party service providers to operate, including cloud database hosting (Supabase), transactional email providers, AI model providers, and GitHub (for Phase 2 repository integration). Your use of third-party tools like GitHub is subject to their respective terms of service and privacy policies, which operate independently of PyDynamics.

8. Acceptable Use Policy

You agree that you will not:

Attempt to bypass authentication, breach system integrity, or gain unauthorized access to any part of the Platform or underlying cloud infrastructure;
Use the in-browser execution environment, code editor, or API endpoints to execute malicious code, send denial-of-service requests, or launch attacks against third parties;
Systematically extract, resell or redistribute protected course materials without permission, except where allowed by law or an applicable licence;
Impersonate any individual, staff member, or another learner, or misrepresent your age or identity.

9. Software and learning content terms

These terms explain permission to use PyDynamics software and learning materials, and how rights in your contributions are handled. They form part of the Terms of Service. Free learner access does not transfer ownership of the platform or its curriculum.

Operator and ownership

PyDynamics Platform is currently operated by Peniel Mogowane t/a PyDynamics Platform in South Africa. Reservation of the PyDynamics name does not mean that a company has been incorporated or that a trade mark has been registered. Any future operator change will be communicated; registration alone does not transfer intellectual property.

Original platform code, lesson text, exercises, quiz wording, project briefs, assessment materials, designs and recordings are protected to the extent that copyright or other rights subsist and are owned by the operator or their respective owners. General Python concepts, facts and independently developed ideas are not claimed as exclusive property.

Permission to learn and practise

While you have authorised access, you receive personal, non-exclusive permission to use the hosted platform and assigned learning materials for learning and assessment. You may take personal study notes, run and adapt examples supplied for practice, and build your own original solutions. Keep any notices or separate licence conditions attached to supplied examples.

You may include your own original project work in a portfolio, subject to assessment integrity, privacy, third-party rights and any notices on starter material. This does not permit publication of hidden tests, answer keys, whole lesson collections or another learner's work.

Copying and commercial use

Except where permitted by law, these terms or a separate licence, do not copy or distribute the platform source, systematically extract the curriculum, resell learning materials, remove ownership notices or rebrand the platform as your own. Self-hosting, white-labelling, curriculum resale and commercial redistribution require separate written permission from the relevant rights holder.

A public website or repository is not by itself permission for unrestricted reuse. A valid open-source, Creative Commons or other licence attached to particular material continues to govern that material. Rights already granted are not withdrawn by this notice.

Your code and other contributions

You retain the rights you hold in your original submitted code, forum posts and other contributions. Submission does not assign those rights to PyDynamics. You must have permission to submit any third-party material and identify applicable licences.

You grant the operator a non-exclusive, royalty-free licence, for the period reasonably needed for the service and lawful retention, to host, copy for storage and backup, execute, assess and display your contributions to you and authorised reviewers. Necessary service providers may process them for those purposes as described in the Privacy Policy, including AI-assisted feedback. Public display is limited to content you deliberately publish through a public feature or separately authorise.

This licence does not authorise selling your work as PyDynamics content, promotional use of identifiable work or independent AI-model training. Those uses need a separate lawful basis and any required permission. Account deletion and retention requests follow the Privacy Policy; ending access does not retrospectively invalidate permitted processing.

Organisations and sponsorship

An organisation's accounts and staff access permit only the agreed hosted learning activities within assigned permissions. Account registration, facilitation or sponsorship does not grant source access, curriculum ownership, exclusivity, equity, unrestricted learner data or a right to operate a competing copy.

Group delivery, approved offline copies, branding, reporting and custom development must be scoped in a separate agreement. Any assignment, exclusive licence, acquisition or investment requires its own signed terms.

Third-party and AI-assisted material

Open-source packages, third-party resources and separately licensed material retain their own terms and ownership. PyDynamics does not claim ownership of Python, its ecosystem or material belonging to another training organisation. Applicable third-party terms prevail for that material.

AI assistance does not establish originality, exclusivity or freedom from third-party rights. Review outputs before reuse. Do not upload confidential third-party work, credentials or personal information that you are not authorised to share.

Brand and attribution

You may accurately describe your participation and link to PyDynamics. Use of its logos, certificates or name to imply endorsement, partnership or accreditation requires permission. Name reservation is not evidence of a registered trade mark.

Concerns and permissions

Send permission requests or suspected infringement reports to info@pydynamics.co.za. Identify the work, its location, your rights or authority, the concern and a contact method. Do not include unnecessary identity documents or confidential learner records. We may restrict access to disputed material while investigating; a report alone does not prove infringement.

Law and updates

South African law applies. Nothing in these terms removes mandatory consumer rights, lawful copyright exceptions or rights granted under a separate valid licence. These terms supplement the Terms of Service and do not certify legal or privacy compliance.

Versions will be dated and material changes communicated through appropriate platform or account channels. Where fresh agreement is legally required, publication or continued use alone will not replace it. A separate signed agreement prevails for expressly agreed rights, subject to mandatory law and third-party rights.

10. Disclaimers

The Platform is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not guarantee that the Platform will operate uninterrupted, error-free, or entirely secure at all times.

11. Limitation of Liability

To the maximum extent permitted by South African law (including the Consumer Protection Act 68 of 2008 where applicable), Peniel Mogowane trading as PyDynamics Platform shall not be liable for any indirect, incidental, special, or consequential damages, loss of data, loss of profits, or operational downtime arising out of or in connection with your use of, or inability to use, the Platform.

13. Termination

We reserve the right to suspend or terminate your access to the Platform at our sole discretion, with or without notice, for conduct that violates these Terms or harms the operational security of the Platform. You may terminate your account at any time by discontinuing use and submitting an account deletion request to info@pydynamics.co.za.

14. Changes to These Terms

We may revise these Terms from time to time. Updated versions will be posted on pydynamics.co.za with a revised "Last Updated" date. Material changes will be communicated through appropriate platform or account channels. Where fresh agreement is required by law, mere publication or continued use does not replace that agreement. Changes do not retrospectively withdraw rights validly granted under a separate licence.

15. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of the Republic of South Africa. You agree that any legal proceedings or disputes arising from or relating to these Terms or your use of the Platform shall be subject to the jurisdiction of the competent courts of South Africa.
